Courts aren’t prepared for complex economic procedures

Rogério Fernandes Ferreira considers that courts should have adequate means to their attributions and competences, so that the limitation period of the procedures decreases.

The Partner and Founder of RFF & Associados defends that changes on the limitation periods deadlines - that "are already high" on the infringement proceedings - are not the solution for the issue and underlines that the limitation period "is a legal instrument that can - and should - be used as a warranty of the defendants' rights" but it should have a "compatibility of the justice demands with the individual guarantees". Avoiding the prescription of procedures implies "equipping the courts and other public entities" with the adequate means and reassuring the surveillance over the judicial bodies
